TERMS AND CONDITIONS OF BUSINESS

GENERAL

  1. These terms and conditions apply to all services provided by Warwickshire Legal Recruitment (“WLR”) and include all locums, permanent placements and all typing assignments from time to time undertaken by the Company. On behalf of any person, firm or Corporation hereinafter referred as (“the Client”) to whom any Candidate previously referred to is introduced by WLR.
  2. The Client accepts these terms and conditions as soon as instructions are given to WLR in connection with Recruitment as mentioned aforesaid. This includes the introduction of Candidates by way of interview or in the case of an interview within the previous twelve months where the introduction of the Candidate was effected by WLR. These terms cannot be varied without prior consultation with WLR as a result of which any variation of these terms and conditions must be confirmed in writing by WLR to the Client prior to a Candidates interview.
  3. WLR are deemed to have introduced Candidate to the Client whenever a Candidates name or details are submitted to the Client either orally or in writing directly or indirectly. This deemed introduction is irrespective of the Client previously having had details of the Candidate provided in any way what so ever.
  4. There is no VAT payable upon introduction fees.
  5. WLR fees are to be settled within fourteen days of the date of WLR’s invoice which will be submitted to the Client upon the Candidates commencement of employment with the Client.
  6. WLR reserves the right to revise Terms and Conditions by the giving of one month’s notice to the Client.

FEES PAYABLE

  1. Fees are payable by the Client upon engagement of the permanent placed Candidate introduced by WLR. A reduced rate fee is payable by current members of the Warwickshire Law Society. A reduced rate payable to such members is ten per cent of the permanent Candidates total remuneration. Where Clients seeks to avail themselves of this reduction they should be able to provide evidence that they have Corporate Membership of the Warwickshire Law Society. For non members of the Warwickshire Law Society the fees are based on eighteen per cent of the Candidates total remuneration.
  2. Remuneration is to include total remuneration that is the Candidates gross salary together with any bonuses or other benefits including the provision of a car which is deemed to be valued at six thousand pounds per annum. If no remuneration is set by the Client then the agreed fee payable to WLR will be calculated in accordance with the Candidates last known remuneration.
  3. For candidates engaged on locum/temporary work the Candidates remuneration on short term contracts will be calculated weekly and is payable within seven days of the expiration of the first week of the Candidates employment with the Client. On longer term placements remuneration is payable monthly.
  4. If a Candidate engaged by the Client on a permanent placement ceases to be engaged by the Client within four weeks of the date of commencement of the Candidates employment then WLR reserve the right to introduce a replacement Candidate to the Client and in which case no further introduction charge will be payable provided always that if WLR are unable to provide a suitable replacement within four weeks of the date of the Candidate ceasing to be employed by the Client then a fifty per cent fee credit will be given to the Client.
  5. The Client must notify the WLR within seven days of terminating the Candidates employment for the aforesaid refund to be given. The refund will only be given in circumstances where the introduction fee was paid by the Client on the due date. The termination should also be genuine if the termination is due to redundancy or if the Client leaves the firm on their own volition then no credit will be given.
  6. If the Client subsequently reengages the Candidate within twelve months of the date of termination the introduction fee remains payable in full and WLR are entitled to be reimbursed by the Client for any refund/credit given.

CONFIDENTIALITY/REFERENCES

  1. WLR ask all Candidates to complete a Candidate Registration Form. WLR are not responsible for checking the Candidates details and the Client should ensure that references, practising certificates any relevant work permits and academic qualifications are checked by the Client. WLR will not be held responsible by the Client for any loss, damages, claims, costs or other payments incurred by the Client as a result of the engagement or otherwise of any Candidate introduced by WLR.
  2. The Client must treat Candidates details submitted in the strictest of confidence and the details should not be disclosed to any other parties without the consent of both WLR and the Candidate concerned.
